The Act of May 15th 1992 (No. 47) about salmon fish and freshwater fish.
The Act regulates salmonoids (salmon, sea trout and sea-char) as well as fresh-water fish.
By freshwater fish means any other fish than salmonoids, included eel. With regards to freshwater fish, crayfish is also included. The purpose of the Act is to secure the natural stocks of salmonoids, freshwater fish and their natural habitats and that other freshwater organisms are managed in a way that nature’s variety and productivity is maintained. Some parts of the Act (as import restrictions and rules about cultivating activities) are applied to all freshwater organisms.
The Act introduces the principle of preservation regulations for salmonoids and for other fish in river systems or parts of river systems where salmonoids are running. This also implies that fishing for salmonoids are prohibited unless such fishing has been given a go ahead. Provisions of the Act open up for fishing of salmonoids in the sea and in river systems during set times and with specific equipments. Salmonoids that are caught with equipment that has been made illegal for such fishing or caught outside the legal fishing time for such fish shall be released.
The principle of preservation regulations does not include other freshwater (inland) fish. The Act gives no general regulations regarding fishing times for freshwater fish, but it allows for local regulations, i.e. municipalities, single river systems or other areas. These regulations are provided by each County’s Chief Executive Officer.
The Act includes prohibition regarding import of live salmonoids, inland fish, hard roe or fry and live feed for such fish. It is also prohibited to release fish or initiate cultivation programmes without permission. The Act prohibits certain activities, including catch and killing methods as well as giving rules for water-flow-artery and fishing and traffic regarding fishing with nets etc.
The Act also contains various provisions about fishing rights, organisation and management of rivers, control and bailiffs, registration of fishing equipment and catch registration.
